Patient rights violations occur more often than you think.
The reason these violations go undetected is because many people are unaware of their rights. Through various laws and regulations, the government has afforded many rights to patients.
At Paden Legal Services, we offer free consultations to our clients on their patient rights. We will refer you to the correct government agency to file a complaint, or if litigation is warranted, we will refer you to another firm to review your case.

Examples of Patient Rights Violations


- Billed for services never received
- Fraud and abuse laws are supposed to prevent healthcare entities from charging for services that are either medically unnecessary or were never actually performed. However, these types of violations still routinely occur.
- Not receiving informed consent before a procedure
- Providers are required to properly inform you of the benefits and risks associated with the procedure.
- Properly credentialed providers
- Healthcare entities are required to review the background of their providers before granting privileges. Often times, providers are not properly credentialed and lack the appropriate training to do the procedures they've been granted privileges for.
- Privacy and confidentiality of medical record information
- The Health Insurance Portability and Accountability Act (HIPAA) gives patients the right to privacy and confidentiality of their health information.
- Emergency medical treatment
- Healthcare facilities with a dedicated emergency department and enrolled in Medicare are required to comply with the Emergency Medical Treatment and Active Labor Act (EMTALA). This means you must be given a medical screening exam, and stabilized if there is an emergency medical condition.
- Copies of medical records
- Healthcare facilities are required to provide you with copies of your medical records within a specified amount of time.
